A trust is an arrangement whereby the creator (settlor or grantor) of the trust transfers property to another who then manages the property for the benefit of the trust beneficiaries. A trust is a separate entity that can continue to operate after the settlor's death. A trust can avoid the need for court-appointed guardianship proceedings over your assets if you become incapacitated. Probate administration can be avoided for the assets held in a trust. Your estate plan remains confidential because trust agreements are not filed with the court or made public.
